Taxation law, int. taxation law

Taxation law is one of the most complex legal areas. It consists of an almost overwhelming number of statutes which are in a constant state of flux. Practically any alteration in life situation has fiscal implications, either directly or indirectly. We will advise you on the arrangement of your personal and business relations, not only legally but also from a fiscal viewpoint.

Certain issues, such as the formation or restructuring of companies, the regulation of corporate succession, the purchase or sale of companies, bequests and gifts as well as corporate or inheritance law disputes, require qualified advice to arrange these life situations for optimal fiscal effect.

Moreover, we can represent you in the case of disputes with taxation and customs authorities in extra-judicial appeals, in the implementation of temporary legal protection, in actions before the fiscal courts and in appeal proceedings before the Federal Fiscal Court. Besides understanding the material taxation statutes and the highest court judgements passed on the basis of these, it is also particularly important to have an understanding of fiscal procedural law.

In fiscal disputes as in civil cases however, the principle holds that before legal action is initiated the chances of success must be examined and - wherever possible and reasonable - a long and drawn-out legal battle before the fiscal courts or Federal Fiscal Court avoided in favour of extra-judicial settlement. This applies particularly to legal disputes following external tax audits.

The internationalisation of your legal relations means that there will also be cross-border fiscal problems to solve. We see ourselves in this sense not only as international generalists, we also strive, in collaboration with our foreign colleagues and taking account of the fiscal situation on both sides, to find the ideal legal structure, size of participation or other contractual arrangement. The language of negotiation in these cases is usually English.
